The Food Pension Fund
It is laid down in article 142 of the Civil Code and is understood as maintenance allowance everything that is necessary for the maintenance, clothing and medical care as well as education. Both parents have this obligation towards their children. We must differentiate between maintenance and extraordinary expenses.
If a separation or divorce decree has been issued and it is decided that one of the parents has custody of the child, the non-custodial parent is obliged to pay maintenance.
When this maintenance is not paid, there are two ways of claiming it:
The civil route: enforcement of maintenance payments
The parent who has not paid is seized (bank accounts, salaries, pensions, cars, real estate, tax refunds...).
The criminal route: There is a criminal offence of non-payment of child support
This is included in the Penal Code in article 227, which occurs when the maintenance payment is not paid for 2 consecutive months or 4 months alternately. In this case, penal consequences ranging from 3 months to 1 year, or fines to be paid over a period of 6 to 24 months, will be demanded from the debtor.
